Summary: you apply on the Affiliate programme page → the administrator is notified by email → the administrator reviews and sets your commission between 1% and 50% → only then is your affiliate account activated. Nobody becomes an affiliate automatically.
1. Programme organiser
The Empire Terra affiliate programme (the “Programme”) is run by EMPIRE GLOBAL SOLUTIONS S.R.L., tax ID (CIF) 47484918, Trade Register J23/346/2023, share capital RON 200, not registered for VAT, email contact@empireterra.ro (the “Organiser”). These terms supplement the platform Terms and conditions; where they differ on affiliation, this document prevails.
2. Definitions
- Affiliate: an individual or company whose application has been approved by the administrator and whose account has active affiliate status.
- Affiliate link / code: the personal address (empireterra.ro/api/ref/CODE) and unique code assigned to the affiliate.
- Referred client: a user who creates an Empire Terra account after visiting the affiliate link, under section 5.
- Commission: the rate set by the administrator for each affiliate, applied to amounts collected from referred clients.
- Administrator: the platform’s administration (Director) account, which reviews applications and manages the Programme.
3. How to join: application, notification, approval
Participation is by approved application only. No user becomes an affiliate automatically by creating an account, buying a package or any other action on the platform. The steps are:
- Application. The applicant fills in the public form on the Affiliate programme page (name, email, optional phone, promotion channel, audience type and a message) and accepts these terms.
- Administrator notification. The application is stored and the platform administrator is automatically notified by email at contact@empireterra.ro. The applicant receives an acknowledgement.
- Review and commission rate. The administrator reviews the application and, if approved, sets the commission rate between 1% and 50% before activation. The rate is set individually based on channel, audience and expected volume. The administrator may reject an application without giving reasons.
- Activation. Only after approval does the account become an active affiliate. The affiliate receives the personal link, code and approved rate by email; if they had no account, one is created and a secure set-password link valid for 7 days is sent. Status and rate are always visible in the Affiliate dashboard.
Until activation no clients are attributed and no commission is calculated.
4. Eligibility
- Adults (18+) with full legal capacity, companies and sole traders may apply.
- The applicant warrants that the details provided are accurate and that they own or manage the declared channels.
- The Organiser’s staff and administration accounts earn no commission on their own actions.
5. Affiliate link and client attribution
- Visiting the link sets the functional cookie
et_ref, valid for 90 days, which stores only the affiliate code (see the Cookie policy). - A client is attributed to the affiliate if they create their account within those 90 days in the same browser, or through the registration link carrying the code. Attribution happens once, at sign-up, and remains valid while the affiliate is active.
- Accounts that existed before the click are not attributed retroactively. Where links overlap, the last link visited before sign-up applies.
- Self-referral (own account or accounts controlled by the affiliate) earns no commission.
6. Commission
- Commission is a percentage, set by the administrator between 1% and 50%, of amounts actually collected by the Organiser from referred clients for listing packages, subscriptions and add-ons.
- No commission is due on cancelled, refunded, disputed (chargeback) or fraudulent payments; commission on a payment later refunded is offset against future payouts.
- The administrator may change the rate for the future, notifying the affiliate; changes do not affect commission already calculated.
- The price paid by the client is not increased by the Programme: commission is borne entirely by the Organiser.
7. Commission payment
- Commissions are totalled monthly and become payable after the 14-day refund window.
- Payment is made by bank transfer in RON or EUR to the account provided by the affiliate, against an invoice (companies / sole traders) or a collaboration agreement and statement (individuals), with any taxes and contributions required by law withheld where applicable.
- Amounts shown in the affiliate dashboard are estimates until the Organiser’s monthly confirmation.
8. Promotion rules
- Promotion must be fair, not misleading and compliant with advertising and consumer law; sponsored content must be clearly labelled (e.g. “#ad”, “#partner”).
- Prohibited: spam and unsolicited messages, fake accounts, automated traffic, bidding on “Empire Terra” in paid ads without written consent, false earnings promises or prices that do not exist on the platform.
- The affiliate does not represent the Organiser, may not conclude contracts on its behalf and may use Empire Terra marks only in materials provided or approved.
9. Suspension and termination
The administrator may pause or remove affiliate status for breach of these terms, fraud or prolonged inactivity, cancelling commission obtained through a breach. The affiliate may leave at any time by emailing contact@empireterra.ro. Commission due and validated up to termination is paid under section 7.
10. Personal data
Application and affiliate account data are processed to review the application, run the Programme and calculate and pay commission, under the Privacy policy. The dashboard shows affiliates only masked data about referred clients (initial and partly hidden email). Approval and the commission rate are decided by a person, not automatically.
11. Independence and liability
The affiliate acts independently; the Programme creates no employment, agency or partnership. The Organiser’s liability to the affiliate is limited to commission due and unpaid.
12. Changes and governing law
The Organiser may update these terms; the version in force is the one published on this page, and material changes are emailed at least 15 days in advance. Romanian law applies; disputes are settled amicably or by the competent Romanian courts. Questions: contact@empireterra.ro.
